3.2.14     The institution’s policies are clear concerning ownership of materials, compensation, copyright issues, and the use of revenue derived from the creation and production of all intellectual property. These policies apply to students, faculty, and staff. (Intellectual property rights)

Summary

Fayetteville Technical Community College (FTCC) is in compliance with this comprehensive standard.  The College has a well-defined intellectual property rights policy available to all.


Narrative

The Administrative Procedures Manual defines intellectual property as “any creative work which qualifies for protection under the copyright or patent laws of the United States of America.”  Further, “intellectual property created by an employee or student of the College when the employee or student created the intellectual property outside of the course or scope of his/her employment and without the support of the College” is considered independent works.  On the other hand, intellectual property created or produced by an employee or student of the College within the scope of his/her employment or student status and produced with the support of the College is considered college-supported works.

For independent works, the College typically possesses and claims no ownership.  For college-supported works, the College typically owns all intellectual property rights.

The Intellectual Property Policy as it applies to faculty and staff is published in the Administrative Procedures Manual.  The policy as it applies to students is published in the Student Handbook.

In the case of a dispute over ownership, which results in an appeal, the Intellectual Property Committee will hear the appeal and determine ownership.  If the person claiming to be a creator of intellectual property disagrees with the committee’s decision, he/she may then appeal to the College President.
